the spiral in the Leaf Headband comes from the Alliance to the Uzumaki, if Konoha breaks the Treaty (which they did) then Konoha can be revoked the right to use the Uzumaki Spiral.

Because Kushina in an Uzumaki she can survive having the Kyuubi removed, the reason she died was from being Impaled on the Kyuubi claw, if you prevent her from being Impaled and moving the Kids away little bit but still let Minato get Impaled the Canon(of that part at least) is not alt'd then have the Yang half in Naruto and the Yin back is Kushina with the Daughter being special with having true Yin/Yang(not Yin and Yang) Nature and the other five Elements.
