Chapter 6: Before the trial

The process leading up to the first trial day was a roller coaster of emotions and tensions for everyone involved in Jacob's case. From the moment charges were filed against him to the day of the detention hearing, each step was crucial and generated overwhelming anticipation.

The prosecution, led by the lead prosecutor, conducted a thorough investigation to gather the necessary evidence supporting the charges against Jacob. They interviewed eyewitnesses, collected physical evidence, and meticulously reviewed security recordings. Additionally, forensic analyses were conducted, and experts were consulted to support the accusations.

From the defense perspective, Jacob's legal team worked diligently to gather evidence refuting the allegations against him. They interviewed witnesses who could provide relevant information and investigated possible inconsistencies in the victim's and other witnesses' statements. The defense lawyers also consulted experts in various fields to evaluate the evidence presented by the prosecution.

As the day of the detention hearing approached, the level of tension and anticipation increased. Attorneys from both sides prepared their arguments and communicated with their respective clients to ensure they were ready to face the legal process.

Jacob didn't have much to do, so he focused solely on maintaining a stable and serene mindset amidst these waves of strange and bewildering emotions. He felt like he was in a dream—how did he end up killing someone and subsequently getting arrested by the police? He knew he was innocent, and there was no sense of guilt or remorse, as he was aware that he had done the right thing.

One hour before the first trial, where it would be decided whether Jacob would return to his family or stay in a cell until the next trial, he was having a conversation with his lawyer.

Anderson, with his experience, reminded the young man in front of him, "Jacob, before the detention hearing, it's important that we discuss what you can expect and how we're going to approach this situation. Are you ready to discuss the details?"

Seeing Jacob's dazed state, that lost look and the bags under his eyes, Anderson focused his attention on what was about to happen.

Jacob, pulled out of his thoughts, nodded and said, "Yes, I'm prepared. I want to understand what's coming and how we can face it in the best possible way."

"Well... During the detention hearing, the prosecution will present their arguments and evidence to support the charges against you. Our goal will be to question the validity of that evidence and argue for your release on bail. But something important that you must and have to do is to maintain your composure, you must always remain silent."

The above was crucial to demonstrate Jacob's innocence because if it's not done this way, it's very likely to be used against him when the sentence is handed down.

But Jacob, who didn't understand much about laws or trials, asked, "What kind of evidence will they present? Do we have any strategy to refute them?"

Anderson smiled and said, "The prosecution will likely present testimonies from eyewitnesses and any physical evidence they have collected. It's important that we thoroughly analyze this evidence and look for possible inconsistencies or gaps in their narrative. We will also carefully review forensic reports to ensure they are solid and cannot be questioned."

"And what about the victim's and other witnesses' testimonies? How will we address those?" Jacob remembered his brother at this point.

"The victim's and other witnesses' testimonies will be presented, but it's our job to examine their statements for inconsistencies. If there are discrepancies in their accounts or if we find possible hidden motives, we can use that information in our defense. We will also interview any witnesses we can find to get a more complete understanding of the events." This point was very important, and Anderson would be paying close attention to it.

"Do you think we have a chance of being granted bail?" Jacob had doubts, especially since his own brother made a grotesque statement against him.

"If we can demonstrate to the judge that you are not a risk to the community and that there is no flight risk, we have a good chance of being granted bail. But we must be prepared to counter any arguments against it and show that you have a stable life, local connections, and a motive to stay and face the charges." Anderson responded almost immediately.

Jacob showed a determined look and pointed, "So, should I just stay silent and do nothing else?"

"It's important that you be honest with me and the court at all times. Additionally, you must follow all recommendations and restrictions imposed on you while on bail. Remember that any violation could harm your case. Stay in touch with me and let me know of any relevant information you may remember, but always in a discreet manner."

Upon hearing Anderson's words, Jacob nodded and said, "I will do my best to cooperate. I'm willing to follow your instructions..."

"Thank you, Jacob. Together, we will navigate through this legal process and do everything possible to ensure your fair defense. Trust me and the judicial system. I am here to fight for you." As a lawyer, that was all Anderson could do besides defending him.

The day of the detention hearing finally arrived, and both the prosecution and defense presented their cases before the judge. The lawyers prepared their arguments and gathered what they would present in the case, all of which came from the investigation stage.

On the day of the detention hearing, Jacob was filled with nervousness as he was escorted to the courtroom. His mind was filled with thoughts and questions about the outcome of the hearing and how it would affect his future. The hallways of the courthouse were bustling with people, lawyers, security officers, and other defendants awaiting their respective trials.

As he approached the courtroom, Jacob could feel the tension in the air. Footsteps echoed on the floor, creating an echo that seemed to amplify his anxiety. Every time he saw someone looking at him, he wondered if they knew what he was accused of, if they were judging him before he had the chance to defend himself.

Finally, he arrived at the courtroom. The doors opened, and he entered, observing the solemn and formal atmosphere. The judge, sitting on the bench, looked attentively as the lawyers and prosecutors took their places. Jacob sat next to his lawyer, Attorney Anderson, who gave him a reassuring pat on the shoulder.

As the hearing progressed, Jacob listened to the prosecutor's words and the arguments presented against him. Each time they mentioned the charges against him, he felt as if a weight was resting on his shoulders. However, Attorney Anderson quickly rose to refute their arguments, presenting evidence and pointing out possible inconsistencies.

The testimony of the victim and other witnesses was also presented to the court. Jacob listened attentively, feeling a mix of disbelief and anger at the accusations against him. He wanted to stand up and shout his version of events, but his lawyer indicated for him to remain calm and trust the legal process.

The courtroom was filled with emotions. Jacob could feel the gaze of those present, some with expressions of curiosity, others with judgment and condemnation. Every word spoken echoed in his head, reminding him of the importance of this hearing and the consequences he could face if his innocence was not proven.
