Eobard Thawne can't die. He is a living paradox, every time you try to kill him he comes back, even Dr. M tried and didn't work...

In the end, they drafted a list of villains that are already in custody, who would qualify for the death penalty. Names like Eobard Thawne, the Reverse-Flash, who had wreaked havoc through time itself, and Brainiac, who has destroyed entire worlds, were included. Yeah, I can't see them as just lackeys anymore and they were overqualified for that anyway. Hmm, or rather they were like those super-butlers that could be rich, famous, and successful with their skills but chose to stay butlers instead.
