technically joker and most of batman villians can't legally get the death penalty bc batman villians like joker can be classified as mentally unstable or insane as a result it gives them a certain amount of immunity to the law , bc the joker is mentally insane he gets psychological or psychiatric immunity meaning his exempt from the death penalty or normal punishments but he has to go to the asylum for treatment but joker keeps escaping and bc his mentally insane , the law cant punish him , if batman were to kill the joker ,batman would be charged with murder and become a wanted man
